Terms of Service
1. Acceptance of Terms: By accessing or using domainbrokerly’s services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our services.
2. Description of Service: domainbrokerly provides domain brokerage, appraisal, sales, and related services for the purchase and sale of internet domain names. Our services include but are not limited to:
- Domain name brokerage and transaction facilitation
- Domain appraisal and valuation services
- Domain sales platform and offer services
- Portfolio management and consultation
- Market analysis and research
3.User Accounts and Registration: To access certain features, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Domain Transactions : All domain transactions are subject to:
- Verification of domain ownership and transfer rights
- Completion of escrow requirements where applicable
- Payment of all applicable fees and commissions
- Compliance with registrar transfer policies
- Adherence to applicable laws and regulations
5. Fees and Payment: Commission rates and fee structures are clearly disclosed before any transaction. Payment terms include:
- Seller commissions ranging from 7-15% based on sale price
- Buyer premiums of 5% on purchases
- Payment due within specified timeframes
- All fees are non-refundable unless otherwise specified
6.User Conduct: Users agree not to:
- Provide false or misleading information
- Engage in fraudulent or deceptive practices
- Violate any applicable laws or regulations
- Interfere with the operation of our services
- Use our services for any unlawful purpose
7.Intellectual Property: domainbrokerly respects intellectual property rights. Users warrant that:
- They have the right to sell listed domains
- Listed domains do not infringe on trademark rights
- They will not list domains that violate third-party rights
8. Limitation of Liability: domainbrokerly’s liability is limited to the maximum extent permitted by law. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the fees paid for our services
- Actions or omissions of third parties, including domain registrars
9.Dispute Resolution: Disputes will be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.
10.Termination: Either party may terminate this agreement at any time. Upon termination:
- Access to services will be discontinued
- Outstanding transactions will be completed according to existing terms
- Confidential information obligations continue
11.Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12.Changes to Terms: We may modify these Terms at any time. Continued use of our services constitutes acceptance of any changes.
